By downloading, accessing and/or using MP VanMitra Survey App or any page of this App, you signify your assent to this disclaimer. If you disagree with any of these Terms and Conditions of Use, you must immediately discontinue your access to the Mobile App and your use of the services offered on the Mobile App. Continued use of the Mobile App will constitute acceptance of these Terms and Conditions of Use, as may be amended from time to time.

We do not take responsibility for the contents including information, data, statistics, text, photographs, pictures, graphics, messages, files or any other material (i.e. user content) posted, uploaded, emailed, shared or transmitted through this App.

At the end of use, you need to logout from your Account in this App. In case of any unauthorized use of your Account and any other breach of security you must notify us immediately. To the extent permissible under applicable law, we will not be responsible for any loss/damage arising from your failure to comply with the foregoing requirements or as a result of use of your Account, either with or without your knowledge, prior to your notifying us of unauthorized access to your Account.

You shall not transfer your Account to any other person and you shall not use anyone else's Account at any time. In cases, where you have authorized or registered another individual to use your Account, you are fully responsible for (i) the online conduct of such individual; (ii) controlling that individual's access to and use of the Services; and (iii) the consequences of any misuse. You may (whenever applicable):

• use, view and download from our App in a Mobile phone; and
• Transmit audio and video files or images from our Mobile App; subject to the other provisions of these disclaimer. You shall abide by all applicable local, state, national, and international laws and regulations in your use of the Mobile App (including laws regarding Intellectual Property Rights),

You must ensure that all the information you provide to us through MP VanMitra Survey App, is true, accurate, complete and non-misleading. MKCL is not responsible for the correctness of the location, information and data of entitlements.

MP VanMitra Survey App is subject to change by amendment, alteration, modification or withdrawal by the concerned Government. Accordingly, we may update the relevant information as and when required on the basis of such changes by the Government. You should carefully read our full Privacy Policy before deciding to become a User as it is hereby incorporated into these disclaimer, and governs our treatment of any information, including personal information submitted to us. Please note that contents including information, data, statistics, text, photographs, pictures, graphics, messages, files or any other material (i.e. user content) which you may submit on MP VanMitra Survey App may reveal your gender, ethnic origin, nationality, age, and/or other personal information about you. You acknowledge and agree that your submission of any contents including information, data, statistics, text, photographs, pictures, graphics, messages, files or any other material (i.e. user content) is voluntary only in accordance with the procedural requirements for implementing on your part. We are not responsible for and do not endorse any features, content, advertising, products or other materials on or available from Third Party Sites which are displayed on our mobile app. We also do not screen, audit, or endorse these geo locations of the development work and individual benefits.

You acknowledge, consent and agree that we may access, preserve, and disclose your registration and any other information you provide if required to do so by law.

We shall not be liable for any special, incidental, indirect, punitive or consequential damages or loss of use, profit, revenue or data to you or any third person arising from your use of the MP VanMitra Survey App, any platform applications or any of the content or other materials, accessed through or downloaded from MP VanMitra Survey App.

We periodically schedule system downtime for the services for maintenance and other purposes. Additionally, unplanned system outages may occur. You agree that we have no responsibility and we are not liable for:

• the unavailability of the services including those available on Third Party Sites;
• any loss of materials, data, transactions or any other information or materials caused by such system outages;
• the resultant delay, wrong delivery, or non-delivery of data, transactions or any other information or materials caused by such system outages; or
• any outages caused by any third parties, including without limitation, any companies or servers hosting the Services, any Internet service providers, any Third Party Sites, or any Internet facilities and networks.

‘MP VanMitra’ Privacy Policy

‘MP VanMitra GPS’ is a mobile app which aids in completing a part of online process of filing CFR and IFR through MP VanMitra portal. Your access to and use of ‘MP VanMitra GPS’ is subject exclusively to this Privacy Policy. By using the ‘Mobile App’ you are fully accepting the terms, conditions and disclaimer contained in this Privacy Policy. If you disagree with ‘Disclaimer’ you must immediately discontinue your access to the ‘MP VanMitra GPS’ Mobile App.

In order to be a registered user of this ‘MP VanMitra GPS’ Mobile App and to avail the various services offered by the App, during registration a user is required to provide his/her Personal information.

You must ensure that all the information you provide to us through ‘MP VanMitra GPS’ App, is true, accurate, complete and non-misleading. We are not responsible in case the user enters wrong/incorrect/incomplete information (including wrong email ID and/or mobile number). “Personal Information” means information which could reasonably be used to identify the user personally, which may include, but not limited to the following:

• Basic details which you provide in profile such as Name, Phone Number, Email Address, Communication or Permanent Address.
• Photograph provided during uploading of projects.
• Transactions performed which can identify you as an individual through your customer ID or other relevant unique identifier.
• Demographic details such as gender, city, PIN code or nearest location.
• Usage logs/Server logs/Cookies which may contain details of your personal or sensitive personal information.
• Service specific information or identifiers
• Device specific information or identifiers.
• For the purpose of this policy, sensitive personal data or information has been considered as a part of Personal Information, which may include, but not limited to the following:
• Passwords or authentication information for any of our services or apps.
• “Non-Personal Information” shall mean information that does not identify the user or any other individual, and includes session, web beacons and usage and transaction data, aggregate log data and aggregate information. We use this information to inter alia deliver our information to you upon request, to tailor our services to the interests of our users, to measure traffic within our services, to improve the quality, functionality and interactivity.
• Wherever applicable, the user will provide us the following information, which is necessary for provision of services to him/her:
• Basic details which the user provides during the registration process such as Name, Phone Number, Communication or Permanent Address.

In case the user does not provide requisite information/denies consent for the usage of the information provided/later withdraws consent, then we may choose to discontinue or deny the services under ‘MP VanMitra GPS’.

The User’s personal information is collected when s/he provides it for availing services under ‘MP VanMitra GPS’. This personal information concerning the user is accessible to only us authorized officials of state government of Madhya Pradesh and MKCL and may be used by us authorized officials of state government of Madhya Pradesh and/or MKCL -

• To verify your identity for access to ‘MP VanMitra GPS’; • To provide you customized information; • For analysis, testing, improvement of our services; • For processing your requests, enquiries and complaints, customer services and related activities; • For communicating and promoting of various MKCL’s products/services.

We and/or MKCL shall not share / disclose / divulge such personal information concerning you to any third party/ies without your express prior consent. We will strive to keep your personal information confidential and will place reasonable security controls to protect it. Your Personal Information will be kept confidential as required under applicable laws. However, any comments, messages, blogs, scribbles etc. posted/ uploaded/ conveyed/ communicated by you on the public sections of the Mobile App becomes published content and is not considered personal information subject to this Policy. You may request that such information be withdrawn and, we may attempt to withdraw any such information if it is technically feasible to do so and as per the applicable laws.

Further, with respect to Non-Personal Information provided by you, as it does not personally identify you, we may use, disclose, share the Non-Personal Information at our discretion.

The User is responsible for maintaining the confidentiality for creating account, and is fully responsible for all activities that occur under her/his account. The User shall ensure to exit from her/his account at the end of each session using the Logout link. ‘MP VanMitra GPS’ cannot and shall not be liable for any consequence directly and/or indirectly arising from the User’s failure to comply with these conditions. This mobile app may contain links to other sites. Please be aware that we are not responsible for the privacy practices of such other sites. We encourage our Users to be aware when they leave our mobile app and to read the privacy statements of each and every web site that collects personally identifiable information. This privacy statement applies solely to information collected by this ‘MP VanMitra GPS’ Mobile App. This Mobile App takes every precaution to protect users' information. When users submit sensitive information via the Mobile App, the information is protected on servers. We have enabled SSL encryption so as to ensure that your data remains encrypted during transmission to and from the site. These precautions, though industry standard is nonetheless only as secure as the end-user's practice. To ensure that unauthorized parties do not get access to information on this Mobile App, we encourage all users make sure that they log-off from all sessions.

If we decide to change our privacy policy, we will post those changes on our Mobile app so our Users are always aware of what information we collect, how we use it, and under circumstances, if any, we disclose it. If at any point we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we will notify users by way of an app notification. Users will have a choice as to whether or not we can use their information in this different manner. We will use information in accordance with the privacy policy under which the information was collected.
